Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SmartSites, a product of Belmont Digital Marketing (“SmartSites,” “we,” “us”), including the smartsites.pro website and the SmartSites website service (together, the “Service”). By using the Service, you agree to these Terms.

The Service

SmartSites designs, builds, hosts, and maintains websites for insurance agencies. The pages, forms, and features included depend on the plan you choose. Every plan includes hosting, SSL, backups, security updates, uptime monitoring, lead delivery to the addresses you designate, a monthly report of traffic, calls, and quote requests, and registration or renewal of your primary domain in your name while your subscription is active. We may add, change, or discontinue features over time.

Edits and Fair Use

Routine content and image edits are included and are typically completed within 3 business days of your request. “Routine” means updates to existing pages: staff, hours, phone numbers, carriers, photos, wording, and similar changes. New pages, new features, redesigns, or work beyond the scope of your plan are quoted separately and started only with your approval.

Eligibility & Accounts

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of the information you provide, including licensing and coverage information published on your website, and for keeping any account credentials secure.

Subscriptions & Billing

• Plans are billed monthly in advance. SmartSites is $97/month. The optional content add-on (2 blog posts a month, a quarterly page refresh, and Google Business Profile posts) is an additional $100/month and may be added or removed at any monthly renewal. SmartSites together with SmartCSR is $149/month; the content add-on stacks on top.
• There is no setup fee and no long-term contract.
• If a payment fails, we will notify you and allow 10 days to update your payment method before the site is suspended.
• We may change pricing with reasonable advance notice.

Cancellation

• You may cancel at any time by emailing help@smartsites.pro. Cancellation takes effect at the end of the month you have already paid for. There is no penalty and no early-termination fee.
• Months are not pro-rated: if you cancel mid-month, the site stays up and the service continues through the end of that paid month, and no partial refund is issued.
• When cancellation takes effect, hosting ends and the site is taken offline. What you take with you is described under Ownership below.
• We may end the Service with 30 days’ notice. If we do, you receive a pro-rated refund of any prepaid amount and a free, complete site export regardless of how long you have been a customer.

Ownership

• Your domain. Your primary domain is registered in your name from the start. If you cancel, we transfer registrar control to you within 7 days, free, with no conditions and regardless of tenure. This is never withheld.
• Your content. You own your logo, photos, reviews, written content, and the client data submitted through your website. You grant us a limited license to host, display, and process that content solely to provide the Service.
• Your site files. On request after cancellation, we provide a complete standalone export of your website (all pages, images, and content) within 14 days. After 12 months of service the export is free and unconditional. Inside the first 12 months, the export is subject to a one-time $497 build-recovery fee, which takes the place of the setup fee we do not charge. The domain transfer above is never conditioned on this fee.
• What stays ours. Our internal build tooling, templates, components, and systems remain our property. The exported site can be hosted anywhere, but the machinery used to build and maintain it is not licensed for reuse.
• Your accounts. Google accounts such as Business Profile, Analytics, and Search Console are created under your identity where possible, with us added as a manager.

Acceptable Use

You agree not to misuse the Service, including by using it unlawfully, attempting to disrupt or reverse-engineer it, or violating applicable laws and regulations (including insurance, advertising, and privacy regulations). You are responsible for the accuracy of the coverage, carrier, and licensing information on your website and for obtaining any consents needed to collect and process your clients’ information through it.

Intellectual Property

The Service, including its software, templates, design system, and brand, is owned by us and protected by intellectual-property laws. These Terms do not grant you any ownership of the underlying platform or templates, only of your own content and the exported site as described under Ownership.

Third-Party Services

The Service can connect to third-party tools (for example, your CRM, rater, scheduler, or automation platforms). Your use of those tools is governed by their own terms, and we are not responsible for them.

Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee search rankings, traffic, or lead volume. SmartSites is a website service and does not provide legal, insurance, or compliance advice.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your website content, or your data, to the extent permitted by law.

Suspension & Termination for Cause

We may suspend or terminate the Service if you violate these Terms, if payment remains unresolved after the grace period above, or if necessary to protect the Service. The Ownership section still applies.

Governing Law

These Terms are governed by the laws of the State of Utah and applicable United States federal law, without regard to conflict-of-law principles. Any disputes will be brought in the state or federal courts located in Utah.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
